Boulder police arrest three in connection with February assault on University Hill

Boulder police arrested three men Friday night in connection with an assault that took place in February after a snowball-throwing incident in the 900 block of 13th Street.
A group of young people walking home a little before midnight on Feb. 19, 2011, were throwing snowballs at each other across 13th Street and over a dark-colored Jeep Grand Cherokee, which was stopped at a stop sign. Witnesses say the Jeep started down the road, but made a U-turn about a block away and came back toward the group.
According to witnesses, a man jumped out of the Jeep and hit one of the male members of the group across the face with a liquor bottle, cutting his face and causing him serious bodily injury.
Orlando Bustamante-Bello (DOB 3/28/1989) was arrested at the Millenium Hotel on April 29 and faces charges of First Degree Assault in this case. He was taken to the Boulder County Jail where bail was set at $20,000.
The driver and passenger in the Jeep also face charges. Initially, they told police they had picked up an acquaintance and given him a ride, and that the acquaintance was the attacker. They later admitted that they had lied to police to protect their friend, Bustamante-Bello.
Adam Nedelka (DOB 4/06/1990) and Danny Goldberg (DOB 1/04/1990) were also arrested on April 29. Both men face charges of Accessory to a Crime (First Degree Assault). They were taken to the Boulder County Jail. The case number is 11-2284.

According to Boulder Revised Code (BRC) 1981 Section 6-3-9, property owners and managers of rental properties in the University Hill and Goss/Grove neighborhoods are required to contract with trash haulers for pick-up service for the following dates in 2011:
- Spring: Wednesday, May 4, through Monday, May 9; and
- Fall: Saturday, July 30, through Monday, Aug. 29.
The University Hill neighborhood boundaries are from Arapahoe Avenue to Baseline Road and from Broadway Street to Ninth Street, and the Goss/Grove neighborhood boundaries are from Canyon Boulevard to Arapahoe Avenue and from Folsom Street to 15th Street.
The Special Trash Service code requires that properties in these neighborhoods sign up for the program. The City of Boulder’s Environmental and Zoning Enforcement Office (EZEO) will issue a summons to property owners and managers of rental properties in these two neighborhoods if they are not signed up for the program, regardless of the extent of trash violations on their property. The fine for a violation of this section of the code is $250 for a first offense.
The Special Trash Service code requirement was implemented in 2003 as a result of a community group recommendation. During tenant move-in and move-out periods, which occur at the beginning and end of the University of Colorado’s academic year, the Goss/Grove and University Hill neighborhoods experience significant trash impacts. This program was initially developed as a pilot program in 2002. Its success resulted in the development of the specific code requirement.

City to remove emergency call boxes from the Hill due to lack of legitimate use

The call boxes, also known as “blue phones,” have instead become a source of frequent pranks. In 2009 and 2010, police received 351 calls from the blue phones – all of which turned out to be false. In each case, police responded, diverting them from other responsibilities and actual calls for help.
The city has been providing the blue phone service since 2002, and at that time, the equipment served an important safety purpose. Today, however, with the prevalence of cell phones, the police department believes they are no longer needed. Emergency calls for service from that area universally come from cell phones and landlines. In addition, the phones are starting to break and would require costly repair or replacement.
“We remain committed to providing prompt and effective public safety service to University Hill and all other areas of the city. That is our number one priority,” said Police Chief Mark Beckner. “While these phones helped the community feel safer when cell phones were not as prevalent, their value and purpose has diminished with the changing times.”

12th Street/Pennsylvania Avenue
13th Street/Euclid Avenue
12th Street/College Avenue
1000 block of 14th Street
The city has met with both university officials and representatives of CU Student Government, and all are in agreement that the phones on the Hill have outlasted their intended purpose. Any money saved from keeping this equipment operational will be put back into the Hill maintenance fund.
